GoReviewly is an AI-powered platform designed to help businesses collect, manage, and respond to Google reviews. Our Service provides:
- One-tap, one-scan review request functionality for customers
- QR code and NFC card generation for seamless review collection
- AI-powered review response drafting and management
- Review analytics and performance insights
- Direct integration with Google Business Profiles
- SMS and automated review request capabilities
GoReviewly does not directly post reviews to Google; rather, we facilitate the process by making it easier for customers to post authentic reviews themselves.
3. User Responsibilities
Business Account Holders
As a Business Account holder, you agree to:
- Provide accurate and complete business information
- Maintain the confidentiality of your account credentials
- Not impersonate any person or entity
- Comply with all applicable laws and regulations
- Not use GoReviewly to post fake, incentivized, or fraudulent reviews
- Ensure all review requests comply with Google's policies and community standards
- Take responsibility for all activity under your account
Review Request Practices
You acknowledge that:
- Review requests must only be sent to genuine customers
- You cannot offer incentives, discounts, or rewards for positive reviews
- You cannot penalize customers for negative reviews
- You must allow customers to leave honest feedback without bias
- Selective review gating (requesting only from satisfied customers) violates Google policies
Account Security
You are responsible for maintaining the security of your account and password. You agree to notify GoReviewly immediately of any unauthorized access or suspected breach.
4. Intellectual Property
GoReviewly IP
All content, features, and functionality of GoReviewly (including designs, technology, algorithms, code, and UI) are owned by GoReviewly or our licensors and are protected by international copyright, trademark, and other intellectual property laws.
Your Content
By submitting reviews, responses, or any content through GoReviewly, you retain ownership of your content. However, you grant GoReviewly a worldwide, royalty-free, perpetual license to:
- Use, copy, modify, and distribute your content as necessary to provide the Service
- Display your content in analytics, reports, and benchmarking studies (anonymized)
- Improve our AI models and Service features
Use Restrictions
You may not:
- Reverse engineer, decompile, or attempt to access source code
- Modify, adapt, or create derivative works of the Service
- Sell, resell, or commercially exploit the Service
- Remove or alter any proprietary notices or labels
5. Acceptable Use Policy
You agree not to use GoReviewly to:
- Violate Laws: Engage in illegal activities or violate any applicable laws or regulations
- Fraud: Create fake reviews, impersonate others, or submit false information
- Harassment: Harass, bully, defame, or threaten any person or business
- Spam: Send unsolicited messages or abuse the review request system
- Malware: Introduce viruses, malware, or harmful code
- Scraping: Automatically collect or scrape data from the Service
- Competitive Attacks: Post false reviews about competitors or leave reviews on competitor profiles
- Google Policy Violations: Violate Google's review policies, community standards, or terms of service
- Data Abuse: Misuse customer data or contact information
- System Attacks: Attempt to access, test, or probe the security of GoReviewly systems
6. AI-Powered Features
Disclaimers for AI Features
GoReviewly uses artificial intelligence to generate review responses and suggestions. You acknowledge that:
- AI-generated content is provided "as is" and may not always be 100% accurate
- You are responsible for reviewing and editing all AI-generated responses before posting
- GoReviewly is not liable for any errors, inaccuracies, or inappropriate content generated by AI
- AI responses should be customized to reflect your business's voice and brand
- You must verify facts and claims made in AI-generated content
AI Model Improvement
GoReviewly may use anonymized data from the Service to improve AI models and algorithms. Your business data will not be shared with third parties without explicit consent, except as required by law.
Limitations
AI features are provided on an "as-is" basis. GoReviewly makes no warranty regarding:
- The accuracy or quality of AI suggestions
- Whether AI output will be approved by Google
- The effectiveness of reviews in improving your ratings or search rankings
- Availability of AI features at any given time
7. Google Compliance
Google Integration
GoReviewly integrates with Google Business Profiles and Google Reviews. You understand and agree that:
- You must comply with Google's Community Guidelines and Google Business Profile Policies
- All reviews must be from genuine customers based on real experiences
- Incentivizing reviews (with discounts, gifts, or rewards) violates Google policies
- GoReviewly facilitates the process but does not post reviews to Google directly
- You are solely responsible for ensuring your review practices comply with Google policies
Google Policy Changes
Google frequently updates its review policies. You are responsible for staying informed about these changes. GoReviewly will make reasonable efforts to update its Service to comply with policy changes, but we are not liable for violations resulting from policy changes.
Account Suspension Risk
Misuse of GoReviewly in violation of Google policies may result in:
- Review removal from your Google Business Profile
- Suspension or deactivation of your Google Business Profile
- Loss of ability to respond to reviews
- Negative search ranking impacts
GoReviewly is not responsible for any consequences resulting from your violation of Google policies.
8. Disclaimers & Warranties
As-Is Service
GoReviewly provides the Service "as-is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, including:
- Merchantability, fitness for a particular purpose, or non-infringement
- That the Service will be uninterrupted, error-free, or secure
- That defects will be corrected or that the Service will meet your expectations
- Regarding the accuracy, quality, or legality of any Content
No Guarantees
GoReviewly does not guarantee:
- Increases in review volume or rating improvements
- Improved search rankings or visibility
- Customer satisfaction or business growth
- That reviews will not be removed by Google
- Specific uptime or Service availability levels
Service Availability
While we strive to maintain high availability, GoReviewly may experience downtime for maintenance, updates, or unforeseen issues. We are not liable for any losses or damages resulting from service interruptions.
9. Limitation of Liability
Cap on Liability
Except for indemnification obligations or claims arising from gross negligence or willful misconduct, GoReviewly's total liability to you shall not exceed the amount you paid for the Service in the 12 months preceding the claim or $100 USD, whichever is greater.
No Consequential Damages
In no event shall GoReviewly be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including:
- Loss of revenue, profits, or business
- Loss of data or information
- Reputational harm or brand damage
- Loss of customers or goodwill
- Cost of substitute goods or services
This limitation applies even if GoReviewly has been advised of the possibility of such damages.
Jurisdictional Exceptions
Some jurisdictions do not allow limitations on liability. In such cases, the above limitation shall be modified to the maximum extent permitted by law.
10. Indemnification
You agree to indemnify, defend, and hold harmless GoReviewly, its officers, directors, employees, and agents from any claims, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:
- Your use of or misuse of the Service
- Your violation of these Terms or any applicable laws
- Your Content or any reviews submitted through your account
- Claims that your use of GoReviewly violates third-party rights
- Your violation of Google's policies or community guidelines
- Any damage to your business resulting from review practices you facilitated
11. Payment Terms
Pricing and Billing
- Pricing is listed on our website and may change with notice
- Billing occurs annually based on your selected plan
- All prices are exclusive of applicable taxes unless stated otherwise
- You authorize automatic billing to your payment method
Payment Methods
You agree to provide accurate and current payment information. If payment fails, we reserve the right to suspend your account pending payment resolution.
Refunds
Refunds are generally not available except as required by law. Requests for refunds must be submitted within 7 days of the billing date. GoReviewly may review refund requests on a case-by-case basis.
Free Trial
If you receive a free trial, your access will automatically convert to a paid subscription unless you cancel before the trial expires. Your payment method will be charged unless you disable auto-renewal.
12. Termination
Termination by You
You may terminate your GoReviewly account at any time by logging into your account settings or contacting our support team. Upon termination, your access to the Service will end immediately.
Termination by GoReviewly
We may terminate or suspend your account immediately, without notice, if you:
- Violate these Terms or any applicable laws
- Engage in fraud, deception, or misuse of the Service
- Violate Google's policies or community guidelines
- Fail to pay your subscription fees
- Pose a risk to GoReviewly, other users, or third parties
Data After Termination
Upon termination, your account data may be deleted after 30 days. GoReviewly is not responsible for any loss of data following termination. Reviews posted to Google through your account will remain on your Google Business Profile unless you delete them directly through Google.
Survival
The following sections survive termination: Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law.
13. Changes to Terms
GoReviewly reserves the right to modify these Terms at any time. Significant changes will be communicated to you via email or prominent notice on our website. Your continued use of the Service after changes constitutes acceptance of the new Terms.
If you do not agree with updated Terms, you must discontinue using the Service.
14. Governing Law
Governing Law: These Terms are governed by and construed in accordance with the laws of the jurisdiction where GoReviewly is incorporated, without regard to its conflict of law principles.
Dispute Resolution: Any dispute arising from or relating to these Terms shall be resolved through binding arbitration, except for claims of intellectual property infringement or injunctive relief, which may be brought in court. Arbitration will be conducted according to the rules of a mutually agreed-upon arbitrator.
Class Action Waiver: You agree to arbitrate disputes on an individual basis only, not as a class action or representative action.
Attorney's Fees: In any legal proceedings, the prevailing party may recover reasonable attorneys' fees and costs.
